AMENDMENTS IN MOTOR VEHICLE ACT GET THE CABINET APPROVAL


Cabinet recently approved the amendments in the Motor Vehicle Act bill 2016. The bill was introduced with 89 clauses for amendment out of which only 57 were accepted by the Parliament Standing Committee on Transport, headed by Mukul Roy. Major amendment includes linking of driving licence and vehicle registration with Adhaar-based platform and proposes heavy penalties for traffic violations.

Now people are not required to visit the local RTO office to get a learning licence instead they can apply for the same online. The Bill also proposes Aadhaar-based verification for grant of online services including learners licence. This would ensure the integrity of the online services and also stop creation of duplicate licence.

The bill specifically targets traffic offenders with stringent penal provisions. It has also identified priority areas for improving road safety. Stricter penalties are proposed for high risk offences such as drunk driving, dangerous driving, overloading and non-adherence to safety norms by drivers etc.

The bill aims to provide for maximum governance with minimum government. This would help in reducing the harassment faced by the citizens in the RTO offices. A national data base of vehicles and driving licences would help in safety and security and avoid malpractices.

The two major suggestions rejected by the government include registration of vehicles by only RTO and inspection of vehicles by RTO. Once the bill is approved vehicle dealers will be authorised to issue vehicle numbers and register them through an all-India electronic register.

FARM & CONSTRUCTION VEHICLES ALLOWED IN INDIA WITH BS-III EMISSION NORMS


We all are aware of the switch to the stronger emission norms i.e. from Bharat Stage III to IV, which has turned out to be quite an inflection point in the automotive industry.

Bharat stage emission standards (BSES) are emission standards established by the Indian government to limit air pollutants coming out of internal combustion engines and Spark-ignition engines equipment, including motor vehicles.

Developing Scrappage Eco-system in India

Indian government while actively tracking development in automotive space, has introduces quite many new rules and advance technology processes to improve vehicle quality making them both road worthy & less polluting.

It is understood that, scrapping a vehicle involves not only shredding of parts but also setting up a mechanism that can, in an environmental-friendly manner, dispose of the scrap which includes segregation of metals, non-metals, rubber, and other materials.

Each one of these materials undergoes predefined recycle method, which implies that Scrappage policy can only be implemented only after setting up an eco-system wherein polluting and old vehicles can be duly collected and transferred to authorized dismantling facilities. These facilities would then safely and environment-friendly dispose the old scrap, recovering the reusable metals and materials that can go back into the production-cycle, which will also relieve India of unnecessary imports.

This Voluntary Vehicle Modernization Programme (V-VMP) or the Scrappage programme announced by the transport ministry can boost Commercial Vehicle (CV) sales by a cumulative 65 per cent between fiscals 2018 and 2020.

"The V-VMP scheme can also lead to incremental sales of 4.4lakh CVs (primarily MHCVs) worth Rs 66,000crore, a cumulative growth of 65 per cent during this three-year period". -Crisil Report.

If this scheme gets implemented which most probably will, over 2lakh CVs would get scrapped and replaced in the normal course through the three fiscals, given the current junking rate of around 67,000 units annually. Therefore the total vehicles opting for the scheme will be 6.4lakh.

Sales of medium and heavy trucks will face the increment of over 85% because of their lifespan of 20 years. But, pick-ups, upper light CVs and MHCV buses, which have a lower lifespan of 15-17 years, will have a smaller share in vehicles being scrapped.

 Government will also consider the fact that Transporters scrapping old CVs will not be the buyers of new CVs, since their business is viable using only an older truck. Considering this government may provide a cash discount to those who will be junking old vehicles or make the V-VMP incentive certificate issued to transporters tradable.


A cap on the engine cubic capacity stating the difference between scrapped and new CVs bought under the scheme will be considered by the Government.  Alternatively, the government may provide different incentives, based on engine cc of new CVs bought versus that of the old one scrapped or offer lower benefit for higher differential in engine cc.

INDIAN AUTOMOBILE MARKET ATTRACTING GLOBAL COMPANIES TO DRIVE IN!


India, which is on the verge of emerging the 3rd biggest automobile market in the world is now attracting global companies to drive in and eat the share of pie. Recently KIA, Peugeot & SAIC motors also unveiled their plans to enter the country. In fact as per the recent news KIA is on location hunting process and is likely to finalize Anantpur in Andhra Pradesh as its first plant location and will finalize the deal by February 2017 end.

Recently Toyota Motor president Akio Toyoda and Suzuki Motor chairman Osamu Suzuki had a meeting with the Prime Minister Narendra Modi to apprise him about their recent tie up in Japan and its implications in India.

India is critical for the Japanese parent with 50% of global sales coming from the country, said Maruti Suzuki chairman RC Bhargava. So whatever technology it gets from Toyota will surely be deployed in India, he said   

Not only Toyota & Sukuzi, a number of global bosses are visiting the country to get the hang of market scenario.

Skoda Auto's global CEO Bernhard Maier made a trip soon after taking over. General Motors CEO Mary Barra visited twice in less than a year to restructure local operations and devise a long-term strategy.

Ford Motor executive chairman Bill Ford visited late last year to inaugurate the New Product Development Centre that will create the foundation for India products. Hyundai Motor chairman Chung Mong-Koo is also expected to visit soon to announce the launch of the Kia brand in India.


The Indian automotive industry broke into the top three in 2016, according to rating agency CARE. 

With the passenger vehicle market set to cross the 3 million mark by the end of 2017, India is seen as a future growth centre by all manufacturers. According to IHS Market Automotive, India is expected to be among the fastest-growing markets in the coming five years besides which local regulations are also getting harmonised with global standards.

If you think that’s right, then you are wrong, as men might take more risks which indeed are quite not a good thing as according to the research men are more responsible than women for accidents and that definitely doesn’t make them better drivers or riders.

And moreover women today are not only the driver of a two-wheeler or a four-wheeler but also have become the driving force of the automotive industry. A woman today has very effectively has created a name for themselves in this male dominating industry, by working triple times harder than their male counterparts.

In India, even in the 21st century women has limited choices of professions so they mostly opt for vacancies in information technology, engineering or even medicine, fashion designing sector. NEWLY AMENDED AUTOMOBILE BILL – TRANSFORMING TOMORROW



Motor vehicles including, automobiles was first introduced in India at the end of 19th century. And to regulate their use 1914 Act was the first to be codified which had 18 sections under it.

Government plays a vital role in a citizen’s life by implementing laws and regulations as they are warnings for our safety only and we must follow it, as good laws are the offspring of bad actions only. With evolving times laws for automobile also evolved, from 1914 Act to Indian Motor Vehicle Act1924, Motor Vehicles Act 1939, which came into force in 1940.

Later, Motor Vehicles Act, 1988 was introduced which regulated all aspects of road transport vehicles including both transport and non-transport vehicles. The Act provides details of legislative provisions regarding licensing of drivers/conductors, registration of motor vehicles, control of motor vehicles through permits, special provisions relating to state transport undertakings, traffic regulation, insurance, liability, offences and penalties, etc.

To exercise the above legislative provisions Government of India created Central Motor Vehicle Rules in 1989 and made sure that all the rules under the Act are enforced in a well organized manner, as no laws are better than laws not enforced.

Then again in 2016, Union Cabinet chaired by Prime Minister Narendra Modi gave the approval to new amended motor vehicle bill in 2016.

 The step was taken to address the issue of road safety and to enhance the customer experience while dealing with the Ministry of Road Transport & Highways which is constituted of Group of Transport Ministers.

Amendments on the existing rule were made to improve the transport scenario in India and to address the issue of road safety by lowering down accidents and fatalities by 50% as over 5 lakh road accidents in a year are reported in the country in which over 1.5 lakh people lose their lives.

The bill aims to amend 68 sections out of 223, it also state the increase in compensation for hit & run cases from Rs. 25000 to Rs. 2 lakhs and payment of compensation upto Rs 10 lakh in road accidents fatalities.

In case, of offence committed by the Juveniles owner/guardian will be deemed guilty and juvenile to be tried under JJ Act, registration of the vehicle would be cancelled as well.

With the aim to properly implement the bill electronic detection devices will be installed to detect the violation like juvenile driving, drunken driving, driving without license, dangerous driving, over-speeding, overloading etc. and people who will break these rules will face strict punishments.

Bill also contemplate to mandate the automated fitness testing of vehicles by october’2018 which will reduce the corruption in transport department while decreasing the human interference and will also increase the road worthiness of the vehicle.

Government is playing its part for pollution free India, but laws alone cannot secure the country until every man present in the country follows them in an organized manner.
